Resolving Medicare and Medicaid Liens
When a personal injury case settles, Medicare and Medicaid may claim reimbursement from the settlement for medical care they paid for that was related to the injury. The official contacts, pages, and portals below are the starting points for reporting a case, requesting conditional payment amounts, and resolving Medicare and Medicaid claims.
Medicare (Federal)
- Medicare Secondary Payer and Coordination of Benefits and Recovery Overview (CMS): The Medicare Secondary Payer (MSP) program is in place to ensure that Medicare is aware of situations where it should not be the primary, or first, payer of claims. This CMS page also describes recovery by the Benefits Coordination and Recovery Center (BCRC) and the Commercial Repayment Center (CRC).
- Benefits Coordination and Recovery Center (BCRC), Beneficiary Services (CMS): Beneficiaries and their representatives can request specific case status information by contacting the BCRC. Phone: 1-855-798-2627 (TTY/TDD: 1-855-797-2627 for the hearing and speech impaired), Monday through Friday, 8:00 a.m. to 8:00 p.m., Eastern Time, except holidays.
- Attorney Services (CMS): When an attorney has been hired, one of the first steps should be to report the case by accessing the Medicare Secondary Payer Recovery Portal (MSPRP) Report a Case link, or by contacting the BCRC. Attorneys must also send the BCRC proper Proof of Representation, and the page covers conditional payment letters and reimbursing Medicare after a settlement, judgment, award, or other payment.
- Conditional Payment Information (CMS): The BCRC is responsible for recovering conditional payments when there is a settlement, judgment, award, or other payment made to the Medicare beneficiary. To obtain conditional payment information from the BCRC, call 1-855-798-2627.
- Insurer and Third Party Administrator Services (CMS): The Medicare program uses Coordination of Benefits (COB) processes to identify payers primary to Medicare and MSP recovery processes to recover mistaken primary payments and conditional payments. The page explains when to contact the BCRC and when the CRC seeks repayment.
- Non-Group Health Plan Recovery (CMS): The BCRC is responsible for ensuring that Medicare gets repaid by the beneficiary for any conditional payments it makes related to a liability, no-fault, or workers compensation case. The Commercial Repayment Center (CRC) is responsible for recovery of conditional payments where an insurer or workers compensation entity is the identified debtor.
- Commercial Repayment Center (CRC) Contact: If you need assistance regarding a Documented Defense or specific information related to a Group Health Plan recovery case, contact the CRC. Phone: 1-855-798-2627 (TTY/TDD: 1-855-797-2627 for the hearing and speech impaired).
- Medicare Secondary Payer Recovery Portal (MSPRP) Information (CMS): The MSPRP is a web-based tool designed to assist in the resolution of liability insurance, no-fault insurance, and workers compensation Medicare recovery cases, including requesting conditional payment information, disputing claims, and submitting settlement information. For questions related to a case, contact the BCRC at 1-855-798-2627. For registration and other technical issues, contact the BCRC EDI Department at 1-646-458-6740.
- Medicare Secondary Payer Recovery Portal (MSPRP): The MSPRP gives insurers and attorneys the ability to access and update certain case specific information online. Registration must occur before access to the MSPRP is permitted.
- Medicaid Coordination of Benefits and Third Party Liability (Medicaid.gov): Third Party Liability (TPL) refers to the legal obligation of third parties (for example, certain individuals, entities, insurers, or programs) to pay part or all of the expenditures for medical assistance furnished under a Medicaid state plan. By law, all other available third party resources must meet their legal obligation to pay claims before the Medicaid program pays.
- Mandatory Insurer Reporting for Non-Group Health Plans, Section 111 (CMS): Section 111 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) added mandatory reporting requirements with respect to Medicare beneficiaries who receive settlements, judgments, awards, or other payment from liability insurance (including self-insurance), no-fault insurance, or workers compensation. For reporting assistance, contact the BCRC at 1-855-798-2627 (TTY/TDD: 1-855-797-2627).
