Domesticating Foreign Subpoenas
When a case is pending in one state and a witness or records are located in another, the foreign subpoena has to be domesticated, which means reissued under the law of the state where the discovery will be conducted. Most states have adopted the Uniform Interstate Depositions and Discovery Act (UIDDA), which lets a clerk of court issue a local subpoena from the foreign subpoena with minimal court involvement. A few states still use older commission or court order procedures, and one state on this list has enacted the UIDDA with a future effective date. The entries below give each jurisdiction’s current mechanism and citation and, where the state publishes one, a link to the official form or instructions. Procedures are set by each state’s law and the official source controls, so always confirm the current statute or rule before serving. Some of the background articles linked below are from prior years and are included as starting points only.
